Terms and Conditions for Computer Repair, Onsite Services, and Text Messaging Communications
By requesting service, dropping off equipment, scheduling onsite support, signing a work order, approving an estimate, communicating by text message, email, phone, or through our website, you ("Customer") agree to the following Terms and Conditions with ECP Computers & More ("ECP," "we," "our," or "us").
1. Services Provided
ECP Computers & More provides, but is not limited to:
- Remote technical support
- Business IT services and managed services
- Onsite technical support
- Security camera installation and support
- VoIP phone system installation and support
- Hardware installation and upgrades
- Software installation and troubleshooting
- Virus, malware, and spyware removal
- Data backup and recovery services
- Network and Wi-Fi troubleshooting
- Computer diagnostics and repair
2. Diagnostic Fees
All equipment may be subject to a diagnostic fee.
- Diagnostic fees are non-refundable once diagnostic work has begun.
- A diagnostic fee does not guarantee successful repair.
- Customers will be contacted with repair recommendations and estimated costs before additional work is performed whenever practical.
3. Repair Authorization
By providing equipment for service, Customer authorizes ECP to:
- Inspect, test, diagnose, repair, and configure equipment.
- Install software updates, drivers, patches, and security fixes as necessary.
- Remove malicious software or unwanted applications.
- Access the device solely for the purpose of performing requested services.
- Equipment, or computer devices are only accepted in an unknown state and will be considered AS IS.
Customer certifies they are the legal owner of the equipment or have authority to authorize service.
4. Data Backup and Data Loss
Customer acknowledges:
- ECP is not responsible for loss of data under any circumstances.
- Hardware failures may worsen during diagnostics or repair.
- Operating system repairs, malware removal, upgrades, and hardware replacement may result in loss of data.
Customers are strongly encouraged to maintain a complete backup of all important files before service begins.
Unless specifically contracted in writing for backup or recovery services:
ECP assumes no responsibility for data loss, corruption, missing files, application settings, passwords, software licenses, or system configurations.
5. Limited Warranty on Repairs
Unless otherwise stated in writing:
- Labor performed by ECP is warranted for thirty (30) days from the completion date.
- New hardware installed by ECP is covered by the manufacturer's warranty only.
- Used or refurbished hardware may carry a separate warranty as specified on the invoice.
- Warranty coverage is void if equipment is tampered with, modified, physically damaged, infected by malware after repair, or serviced by another party.
Warranty remedies are limited to re-performance of the original repair service.
6. Customer-Supplied Parts
When customers provide their own hardware or replacement parts:
- ECP cannot guarantee compatibility or performance.
- ECP provides no warranty on customer-supplied parts.
- Additional labor charges may apply if troubleshooting customer-supplied components is required.
7. Abandoned Equipment
Equipment left unclaimed for more than thirty (30) days after notification of completion may be considered abandoned.
ECP reserves the right to:
- Charge storage fees.
- Recycle, dispose of, or sell abandoned equipment as permitted by applicable law.
- Apply proceeds toward unpaid balances.
8. Payment Terms
Payment is due upon completion of services unless otherwise agreed in writing.
ECP reserves the right to:
- Retain possession of equipment until all charges are paid in full.
- Suspend ongoing services for overdue accounts.
- Charge reasonable collection costs and attorney fees where permitted by law.
Returned checks may be subject to additional fees.
9. Onsite Service Terms
For onsite service appointments:
- Customer agrees to provide safe and reasonable access to equipment and work areas.
- Service delays caused by inaccessible equipment, third-party vendors, utility providers, or customer personnel may result in additional charges.
- Travel charges may apply outside standard service areas.
- Scheduled appointments canceled with less than 24 hours notice may be subject to a cancellation fee.
10. Remote Support Services
For remote support sessions:
- Customer authorizes ECP to access systems remotely.
- Customer understands that remote support requires internet connectivity and may not resolve all issues.
- ECP may recommend onsite service if remote support is insufficient.
11. Limitation of Liability
To the fullest extent permitted by law:
ECP Computers & More shall not be liable for:
- Loss of profits
- Business interruption
- Loss of revenue
- Loss of data
- Loss of goodwill
- Loss of software licenses
- Incidental, indirect, special, or consequential damages
ECP's total liability for any claim shall not exceed the amount paid by Customer for the specific service giving rise to the claim.
12. Software Licensing
Customers are responsible for maintaining valid software licenses.
ECP will not knowingly install unlicensed, pirated, or unauthorized software.
13. Passwords and Security
Customers may be required to provide passwords, encryption keys, or administrator credentials necessary to perform services.
Customers are responsible for:
- Maintaining copies of passwords.
- Updating passwords after service if desired.
- Ensuring account security.
ECP is not responsible for account lockouts or security changes implemented by third-party providers.
14. Text Messaging Communications (SMS Terms)
By providing a mobile phone number to ECP Computers & More, Customer agrees to receive text messages related to:
- Appointment scheduling
- Appointment reminders
- Service updates
- Repair status notifications
- Invoice and payment reminders
- Customer support communications
- Promotional offers (where permitted by law)
Message Frequency
Message frequency varies based on service activity and customer interaction.
Message and Data Rates
Message and data rates may apply according to Customer's mobile carrier plan.
Opt-Out
Customers may opt out of text messages at any time by replying:
STOP
After opting out, customers will receive a confirmation message and will no longer receive SMS communications except where legally permitted.
Help
Customers may reply:
HELP
for assistance or contact ECP directly.
No Carrier Liability
Wireless carriers are not liable for delayed or undelivered messages.
15. Privacy
Customer information will be used only for business operations, service delivery, billing, customer support, and communications.
ECP does not sell customer personal information to third parties.
Information may be disclosed:
- When required by law.
- To process payments.
- To perform contracted services.
- To protect the rights, safety, or property of ECP and its customers.
16. Force Majeure
ECP shall not be liable for delays or failures caused by events beyond its reasonable control, including:
- Natural disasters
- Severe weather
- Utility outages
- Internet outages
- Government actions
- Labor disruptions
- Supply chain shortages
17. Governing Law
These Terms and Conditions shall be governed by the laws of the Texas, without regard to conflict of law principles.
Any disputes shall be resolved in the courts located in the county where ECP Computers & More maintains its principal place of business.
18. Acceptance of Terms
By signing a work order, approving an estimate, requesting service, scheduling an appointment, submitting equipment for repair, communicating by text message, or otherwise engaging ECP Computers & More for services, Customer acknowledges that they have read, understood, and agree to these Terms and Conditions.
